The term PAT generally refers to in-service inspection and testing of portable appliances.

Electrical appliances are built to specific standards and these appliances undergo Type Approval Tests and the Production Line Tests by the manufacturer before they reach the customer to ensure that they conform to the required standards.

PAT testing is essentially a repeat of the electrical safety tests that were carried out at the time the product was built. It is a periodic in-service electrical safety inspection and test to ensure that the electrical safety of the appliance is not compromised while the equipment is in service.

The Safety Health & Welfare at Work (General- Application-Regulations) 2007 sets out general duties for the testing of new and existing installations.

Regulation 89 of the legislation states

“An employer shall ensure that -

(a) A new electrical installation and a major alteration of, or extension to, an existing electrical installation is, after completion, inspected and tested by a competent person

(b) An existing electrical installation is tested by a competent person in an appropriate manner–

(i) from time to time where required having regard to the nature, location and use of the installation, or

(ii) if an inspector so requires, and a report of the test is completed by the competent person carrying out the test,

(c) All defects found during the testing and inspections of an electrical installation are rectified promptly so as to prevent danger.

The law states that:

• tests have to be periodic and carried out by competent personnel
• all tested appliances have to be labelled, whether passed or failed
• test results have to be recorded and kept at least 5 years

 

What are the penalties for breaches of health and safety legislation?

Most offences, including any breaches of Regulations under the 2005 Act may be tried either in summary proceedings in the District Court where the max penalty is €5,000 per charge and/or up to twelve months imprisonment or on indictment in the Circuit Court where the maximum penalty is €3,000,000 and/ or imprisonment for a term not exceeding two years.
